Florida Eviction Process Overview

In Florida, the eviction process for non-payment of rent follows a specific legal sequence outlined in Florida Statute §83.56:

1. 3-Day Notice to Pay Rent
The landlord must first serve the tenant with a written 3-day notice demanding payment of past-due rent or possession of the property. This notice must be properly delivered before any eviction case can be filed.
2. Waiting Period
The tenant has three business days (excluding weekends and legal holidays) to pay the rent owed or vacate the property.
3. Filing an Eviction Case
If the tenant does not comply, the landlord may file an eviction lawsuit with the county court.
4. Court Process
The court reviews the case, and if the landlord prevails, a judgment for possession may be entered.
5. Writ of Possession
The sheriff posts a writ of possession, and if the tenant does not vacate, the sheriff may remove the tenant from the property.
